IT’S OFFICIAL! Yesterday was a monumental day for Arizona contractors as Governor Doug Ducey signed SB1271 into law! Pursuit of proportional liability and other remedies related to unfair risk transfer have been a top legislative priority for years and thanks to an amazing, dedicated team led by Senate President Karen Fann the first leap forward is official. On behalf of the ASA of Arizona Board of Directors and Arizonans for Fair Contracting Steering Committee, we extend our sincerest thanks to each and every ASA member and member of industry that supported this effort by reaching out to legislators to ask for their support, attended committee hearings, and/or made a financial contribution to help underwrite the cost. This effort would not have been possible without you.
Along with President Fann and our lobbyist team at DeMenna Public Affairs, we are extremely grateful to the members of the Construction Liability Apportionment Study Committee (CLASC), legislative staff, Technical Advisory Committee (TAC), and stakeholder meeting participants that came together to pursue this positive change for the Arizona construction community. Stay tuned in the coming weeks as we provide information, FAQs, and educational programs on the implementation and impact of this new addition to state statute. Further, SB1271 extends the statutory study committee — CLASC — for another year to allow Senator Fann, the TAC, and industry stakeholders to address unresolved risk transfer concerns impacting commercial construction. Information on next steps will be shared as it becomes available.
