Members and Supporters,
A lot has happened since the start of the 2018 Legislative Session and we have made tremendous progress toward leveling the playing field for Arizona contractors in the private sector. Since the introduction of SB1271 we have faced opposition at every step in this process, but we’ve managed to get unanimous support for SB1271 in both the Senate Commerce & Public Safety and Senate Judiciary Committees.
Before SB1271 was set to go to the Senate floor for a vote by all 30 members, our bill sponsor Senator Karen Fann, ASA leaders, the Arizonans for Fair Contracting team, and stakeholders in the Arizona contracting community came together to discuss the future of this legislation. The stakeholders at the table agreed that the legislative process simply moves too fast to identify a comprehensive, consensus solution that everyone can support. In order to find this solution, the stakeholders agreed to transform SB1271 into a Statutory Study Committee with a comprehensive scope that will address multiple issues in the Arizona contracting industry, such as indemnity, right to repair, construction defects, and many other important issues for all parties involved in private construction projects. The Study Committee will be tasked with developing a legislative solution to address these issues in the 2019 Legislative Session. In other words, SB1271 has been changed into a bill that will require the Arizona Legislature to identify solutions to these issues and produce a plan of action!
The important takeaway from all of this is that even though SB1271’s overall purpose has been altered, we still must secure its passage in order for the Study Committee to be formed and these important issues to be addressed. At this point we are over half-way there after a unanimous 30-0 vote in the Senate last week! However, we still have to move SB1271 through the House of Representatives.
SB1271 has been scheduled to face the first hurdle in the House of Representative next week on Tuesday, March 20, and we will hold a rally at the Capitol that day, just like we did when the bill started moving through the Senate. We need your support! We ask that supporters meet us at the Capitol at 1:00 PM so we can move everyone by 1:15 PM up into the 3rd floor gallery of the House of Representatives (located directly across the quad from the Senate building). Arizonans for Fair Contracting supporters and members of industry will be introduced by a member of the House of Representative during the floor session, which begins at 1:30 PM. Afterward, if possible, supporters are encouraged to attend the House Commerce Committee hearing on the bill at 2:00 PM in House Hearing Room 1. Again, dress as you would for the field and bring your safety vests.
Until next week we all need to continue reaching out to legislators and requesting their support for SB1271. There are 60 members in the House of Representatives, so outreach from supporters like you has never been more critical. Let’s get SB1271 through committee and work toward another unanimous vote on the House floor.
