ASA and ASCC support SB1231 Indemnity – Public Construction. The bill passed the Senate and is scheduled for a hearing at 11:00 AM on Monday, March 11th in the House Government Committee.
Please contact Representative Michelle Ugenti, Chairman, and members of the Government Committee to ask for a “YES vote on SB1231 on behalf of Arizona’s construction subcontractors.
You may email or call the members and do both if you can (Member contact list is attached).
SB1231 is good because it limits subcontractors’ duty to indemnify and insure owners and general contractors “only to the extent caused by the negligence, recklessness or intentional wrongful conduct of the subcontractor” or others employed or used by the subcontractor.
If signed by the Governor, the law will apply to all subcontracts for public construction work in Arizona.
You are welcome to attend the Committee hearing on Monday if you are interested in watching the process.
If you have questions or need assistance, contact Richard Usher, Government Relations-Advocacy Committee chairman, at (602)956-4220
