Maricopa County Air Quality Statute Changes Impact Subcontractors and Construction Industry

On March 26 the Maricopa County Board of Supervisors passed a number of regulation changes to its Air Quality Statute, as published in the Arizona Register. Rules affected include Rules 200 (permit requirements) 280 (permit fees) 300 (visible emissions) 310 (dust generating activities) 310.01 (vacant lots) Appendix C (test methods for Rule 310). Additionally, the new requirements include annual registration for subcontractors involved in "dust-generating activity" including a wide scope of construction activity. The annual registration will begin on June 2, 2008 and requires and application with $50 registration fee.
