ASA and ASA of Texas Tell Court: Contractors Should Be Able to ‘Depend’ on Their CGL Policies for Coverage

The American Subcontractors Association, Inc., ASA of Texas and other groups representing the Texas construction industry told the U.S. Court of Appeals for the Fifth Circuit that construction contractors should be able to “depend on their commercial general liability policies for coverage” and that they shouldn’t have to bear the “burden of defending against an adversarial insurer out to minimize its own obligation to defend and indemnify its insured.

ALEXANDRIA, Va. — If a project owner orders a routine work stoppage during the construction phase of a project, should subcontractors have to assume the worst, i.e., that the project has been “abandoned,” and start preparing their lien claims? In an amicus curiae, or “friend of the court,” brief filed on Jan. 4, 2011, ASA and ASA of Tennessee answered “no,” and asked the Tennessee Supreme Court to reverse lower court decisions that leave subcontractors second-guessing as to which project stoppages will “trigger” the 90-day period that they have to file liens.

Subcontractor Legal Defense Fund Case Status Report 2009-2010

The courts are a key battleground in the fight for subcontractor rights. ASA’s Subcontractors Legal Defense Fund (SLDF) and the Subcontractors Legal Research Fund (SLRF) support ASA’s critical legal activities to protect the interests of all construction subcontractors.
